Predictably, left-wing judges tried to slam the brakes.
Obama-appointed Judge James Boasberg blocked Trump’s efforts, claiming even gang members deserved the full weight of due process. But in a narrow 5-4 decision, the Supreme Court ruled that while some due process must be respected, the administration can still deport gang-linked illegal aliens under the Alien Enemies Act.
Shockingly, Justice Amy Coney Barrett sided with the liberal wing of the Court in the ruling—though the Trump administration still walked away with a win.
In a separate fiasco, Maryland District Judge Paula Xinis, another Obama-era appointee, ordered that MS-13 gang member Kilmar Garcia be returned to the United States after being deported. Her excuse? A so-called “administrative error.”
Xinis painted Garcia as a victim, saying the evidence tying him to gang activity “consisted of nothing more than his Chicago Bulls hat and hoodie.”
But here’s the truth: Garcia had already been twice confirmed as an MS-13 member. He wasn’t some misunderstood dad from Maryland. He was involved in human trafficking—a serious threat to Americans’ safety.
Fortunately, Supreme Court Chief Justice John Roberts stepped in and blocked the insane order to bring Garcia back to U.S. soil.
With the road now cleared, ICE is moving full speed ahead. Homan confirmed that ICE will have the final say on deportations under the Alien Enemies Act.
“It can be one factor or up to 20 factors … It’s a case-by-case analysis,” Homan told Axios.

He broke it down even further:
“ICE is the principal arbiter,”
“There’s a Homeland Security task force and a lot of agents involved — But it starts with ICE.”
No more waiting on far-left judges. No more media sob stories.
Homan emphasized that ICE doesn’t make decisions lightly. Agents investigate everything—social media posts, tattoos, criminal records, surveillance, and more.
“We do a deep dive,” Homan said. “People who are enemies of the United States don’t have the same level [of] due process [as in] the normal process.”
He also added a stark warning about criminal histories:
“People keep saying they have no criminal history. I’ve been doing law enforcement since 1984. Many gang members don’t have criminal history. It’s more than criminal history.”
Leftist outlets have worked overtime trying to turn Garcia and others into sympathetic figures. They ran tearjerker stories claiming these deportations were cases of “mistaken identity.” But the facts tell a different story.
Garcia wasn’t some innocent father—he was a violent gang member with a history of trafficking and affiliations with one of the deadliest gangs on the planet.
Democrats and their media allies are furious that they can no longer rely on activist judges to shield violent criminals from deportation.
With the Supreme Court’s ruling in place and ICE unleashed, President Trump’s deportation engine is roaring back to life.
