McCormick described the process as “deeply flawed,” arguing Musk exercised too much influence over the very people tasked with overseeing him.

For critics of Musk, it was a rare victory. For Musk, it was a warning shot.

Fast forward to late 2025, and the Delaware Supreme Court reversed that decision, restoring Musk’s compensation in full. But by then, the billionaire entrepreneur had already begun preparing a far more significant response—one that would ensure such a challenge could never happen again.
