The Biden Justice Department is scrambling to stop a federal judge from upending deportations of dangerous foreign gang members — warning the court system is barreling toward a “needless constitutional confrontation.”
In an emergency appeal filed Friday, DOJ attorney Drew Ensign blasted Chief District Judge James Boasberg for meddling in the president’s foreign policy powers. The Washington Times reported that Ensign accused Boasberg of interfering with last month’s deportations to El Salvador and threatening criminal charges unless hundreds of Venezuelan migrants are brought back to the U.S.

Ensign said Boasberg’s actions are completely out of line, especially since his original ruling was so vague that even now, more than a month later, “the parties are still disputing its meaning.”
“The district court’s criminal contempt order invites needless constitutional confrontation,” Ensign warned in a filing to the D.C. Circuit Court of Appeals.
