If enacted, the move would immediately remove every justice currently serving on Virginia’s highest court.

That would allow Democrats, who control the state legislature, to rapidly install an entirely new bench composed of judges more favorable to their political agenda and potentially willing to approve a revised congressional map after the original effort was rejected.

Republicans blasted the proposal as an unprecedented assault on judicial independence and a direct attack on constitutional government.

House Majority Leader Steve Scalise publicly condemned the reported discussions and accused Democrats of trying to rewrite the rules after losing in court.

He wrote on X:

“Just so we’re clear: Democrats want to rewrite the Virginia Constitution because the State Supreme Court rejected their unconstitutional maps. For a party that loves to chant “No Kings,” this is VERY undemocratic.”

The controversy intensified after The New York Times detailed internal Democratic conversations that reportedly took place following the court’s ruling.

The New York Times reported:

“Democrats are struggling to respond to a major redistricting setback in Virginia, with some party leaders discussing an audacious and possibly far-fetched idea for trying to restore a congressional map voided by the court but showing little indication they have a clear plan.

During a private discussion on Saturday that included Democratic House members from Virginia and Representative Hakeem Jeffries of New York, the minority leader, the lawmakers vented anger at their defeat at the Virginia Supreme Court, spoke about a collective determination to flip two or three Republican-held seats under the existing map and discussed a bank-shot proposal to redraw the congressional lines anyway, according to three people who participated in the call and two others who were briefed on it.”

The report also revealed that Democrats were allegedly exploring ways to restructure the court itself in order to create vacancies that could be filled by Democratic appointees.

“One key to the plan would be having Democrats in Richmond lower the mandatory retirement age for state Supreme Court justices, an idea that began circulating among state lawmakers and members of Congress after a column proposing a version of the idea was published on Friday night in The Downballot, a progressive newsletter.”

The proposal would reportedly require approval from Virginia Governor Abigail Spanberger. However, according to the report, her office declined to comment on the discussions.

The New York Times further reported:

“Ensuring the plan proceeds would involve the General Assembly, which is controlled by Democrats, lowering the mandatory retirement age for Virginia’s Supreme Court from 75 to 54, the age of the youngest current justice, or less. Virginia judges are appointed by the General Assembly, where Democrats hold majorities in both chambers and could then fill vacancies on the court with sympathetic Democratic lawyers.”

Conservatives across the country quickly sounded the alarm, warning that the proposal mirrors the kind of court-packing schemes long criticized at the federal level.

Many observers noted the irony of Democrats repeatedly accusing Republicans of undermining democratic institutions while simultaneously considering drastic measures to remove judges who issued a ruling they did not like.

The episode has also reignited debate over election integrity, judicial independence, and the growing willingness of political operatives to reshape institutions when outcomes do not go their way.

For many Virginians, the fight is no longer simply about congressional maps. It has become a larger battle over whether courts will remain independent guardians of the Constitution — or become political weapons controlled by whichever party holds legislative power at the moment.
