During oral arguments this week, Brett Kavanaugh made a striking observation that cut to the heart of the issue. Referencing concerns about election integrity, he warned that “charges of a rigged election could explode.” It was not a casual remark—it underscored growing unease among conservative justices about ballots being counted after Election Day has passed.

Kavanaugh’s comments suggest that at least some members of the Court are increasingly skeptical of extended ballot deadlines. For many observers, it signals a readiness to revisit how strictly federal election law should be interpreted when it comes to timing.

Fellow Justice Samuel Alito reinforced that message with a more direct critique of the current system. He pointed out that the very concept of “Election Day” has become diluted.
