President Donald Trump has once again put America first—this time targeting those who burn the Stars and Stripes. After decades of courts shielding flag desecration under “free speech,” Trump is demanding consequences for those who torch one of the most sacred symbols of the nation.
On Monday, the President signed an executive order instructing the Department of Justice and other agencies to “vigorously prosecute” anyone who destroys or desecrates the flag. Trump also wants his administration to take the fight all the way to the Supreme Court, asking them to reconsider the controversial 1989 Texas v. Johnson decision, which struck down laws against flag burning in a narrow 5-4 ruling.
In that case, Justice William Brennan wrote that the First Amendment protects symbolic actions, including the act of burning a flag. But Trump has made clear he sees things differently.
“You burn a flag, you get one year in jail. You don’t get 10 years. You don’t get one month. You get one year in jail. And it goes on your record, and you will see flag burning stopping immediately,” Trump declared.
