The U.S. Court of Appeals for the District of Columbia Circuit ruled earlier this month that Smith is not permitted access to Rep. Scott Perry’s (R-Pa.) phone records because doing so would violate Perry’s immunity under the “speech and debate” clause of the Constitution.
According to Politico, Smith was attempting to access Perry’s interactions with colleagues and members of the Trump administration. However, there is a provision that prevents Congressmen from taking part in judicial cases while carrying out their official duties.
“While elections are political events, a member’s deliberation about whether to certify a presidential election or how to assess information relevant to legislation about federal election procedures are textbook legislative acts,” According to the judgment announced last week by U.S. District Judge Neomi Rao.

Judge Karen LeCraft Henderson, a George H.W. Bush nominee, joined two other Trump appointments, Rao and Judge Gregory Katsas.
A lower court judgment by U.S. District Judge Beryl Howell, who mostly supported the government’s request to obtain Perry’s cellphone data, is reversed by the three-judge panel.
Howell is instructed to apply the new ruling once the appeals court returns the case to her jurisdiction.
Smith’s legal team recently asked the federal court presiding over Trump’s Jan. 6 lawsuit for a short-term gag order for the former president.

According to The New York Times, the prosecutors informed the judge that the former president had continued to engage in “a sustained campaign of prejudicial public statements” against witnesses, the prosecution, and others since they first requested a gag order three weeks ago.
Tanya S. Chutkan, a U.S. District Judge, is presiding over Trump’s lawsuit as of January 6. Prosecutors have emphasized the former president’s words aimed at possible witnesses like former Vice President Mike Pence, despite the fact that the request filed three weeks ago is still pending a decision.
The prosecution overlooks an essential point in their case: the former vice president is not only a possible source of information as a witness but also a rival of the former president for the Republican presidential nomination.

According to the petition, Mr. Trump yelled at a different witness in the case, “the former attorney general” implying that William P. Barr had not completed his duties following the election “because he was afraid of being impeached.”
Prosecutors also drew attention to a troubling post that Mr. Trump made about Gen. Mark A. Milley, the outgoing head of the Joint Chiefs, on his social media account. The former president implied treason and even recommended possible execution in the past in response to General Milley’s unfavorable comments of Mr. Trump.
“No other criminal defendant would be permitted to issue public statements insinuating that a known witness in his case should be executed,” Molly Gaston, the prosecutor, said. “This defendant should not be, either.”
