Rep. Andy Biggs (R-AZ) has launched a bold move to remove U.S. District Court Judge James E. Boasberg from his post, arguing that the judge violated the Constitution’s “good behavior” clause. Biggs has introduced a resolution in the House of Representatives to oust Boasberg without needing the traditional two-thirds Senate vote, bypassing the usual impeachment process.
The resolution accuses Boasberg, currently the Chief Judge of the U.S. District Court for the District of Columbia, of abusing his judicial powers to interfere with the authority of President Donald Trump. Biggs claims that Boasberg overstepped his boundaries, particularly when he blocked Trump’s directive to deport members of Venezuela’s violent Tren de Aragua gang under the Alien Enemies Act.

Trump’s proclamation on March 15, 2025, invoked the 1798 law to expel foreign criminals who posed a serious threat to national security. However, Boasberg allegedly intervened and halted the deportations, effectively sabotaging the president’s efforts to protect the U.S. from foreign threats. This act, according to Biggs, undermines the president’s constitutionally-mandated power to secure the homeland.
