A major new battle over birthright citizenship is taking shape on Capitol Hill, and supporters of President Donald Trump believe they may have found a legislative path forward following a recent Supreme Court decision.
Indiana Republican Sen. Jim Banks introduced the Citizenship Act this week, arguing that Congress has the authority to address questions surrounding automatic citizenship for children born to individuals who entered the United States illegally or traveled to the country specifically to give birth.
The proposal arrives just weeks after Chief Justice John Roberts authored the Supreme Court’s decision in Trump v. Barbara, a ruling that reignited a long-running national debate over the meaning of the 14th Amendment and the scope of birthright citizenship.
