Concerns over the Social Security Administration’s mistake of overpaying elderly citizens’ payments are growing among lawmakers. These people are now being requested to refund substantial amounts of money, often hundreds of dollars.

The acting commissioner of the agency is being questioned by Ohio House members on attempts to recover overpayments even when the recipients are innocent. The report is exclusive to Fox Business Network.

Americans who are handicapped or elderly who live on limited incomes run the risk of having their benefits halted or suspended until they pay back their alleged debts.

Leading the opposition to the SSA’s persecution of recipients impacted by administrative mistakes is Congressman Mike Carey of Ohio. Recipients are unfairly treated by the SSA as though they have committed fraud, rather than having their mistakes addressed.

“Seniors and disabled Americans living on fixed incomes are not criminals, and they don’t deserve to be treated like criminals by the federal government over a mistake — and I can’t stress this enough — that is not their fault, but rather the result of a bureaucratic mistake on the part of the federal government,” Carey said.

The December 2021 letter from the constituent revealed the SSA’s admission of the benefit calculation error.

“That constituent not only started receiving more money monthly, but the Social Security Administration sent them a check to cover what was retroactively owed through 2017,” said Carey. “Then, in August of this year, that constituent received a letter from the Social Security Administration saying that the initial miscalculation of their benefits was wrong. This constituent was told they now owed the Social Security Administration more than $7,500 in overpaid benefits, and they had only 30 days to pay it off.”

Lawmakers claim that over a million Americans receive erroneous notifications regarding their Social Security benefits annually. SSA Acting Commissioner Kijakazi presented startling statistics in November during congressional testimony, stating that 986,912 Americans shockingly got clawback notices in the fiscal year 2023. Recipients of Social Security owe the government millions. According to a new CBS “60 Minutes” broadcast, the issue is much worse than first believed. Every year, almost two million Americans are notified that their Social Security benefits were overpaid, as opposed to only one million. This translates to twice as many people battling to pay back the government—often in the tens of thousands of dollars—within the 30-day deadline.

“Older and disabled Americans who have done everything correctly when filing for Social Security benefits but received overpayments through no fault of their own should not be penalized for erroneous mistakes made by the Social Security Administration,” stated the top Democrat who signed the letter, Rep. Emilia Sykes of Ohio.

“Our seniors rely on these payments to pay their bills and put food on the table — they can’t afford for the SSA to be making life-altering errors. This letter seeks to hold the SSA accountable and ensure all seniors receive the correct payments they deserve,” she said.

A spokesman for the Social Security Administration, Nicole Tiggemann, told Fox Business that it is presently unknown how many overpayments have affected the 67 million Americans who receive Social Security.

“Our overpayment systems were not designed to easily determine this information. As part of the review directed by the Acting Commissioner, we are looking at how best to inform the Agency, the public, and Congress about this workload,” Tiggemann said.
