In a pivotal decision, the U.S. Department of Justice has declared it will not prosecute Attorney General Merrick Garland for contempt of Congress. This decision comes in the wake of Garland’s refusal to submit audio recordings related to President Joe Biden’s interview with Special Counsel Robert Hur. The House of Representatives had previously voted on Thursday to hold Garland in criminal contempt for ignoring a congressional subpoena to release the tapes.
Last month, two Republican-led House committees recommended that Garland be held in contempt for not providing the audio from Biden’s discussions with Hur. These tapes, according to reports, contain potentially embarrassing content and have been highly classified, stored in a Sensitive Compartmented Information Facility (SCIF), as per investigative journalist Paul Sperry.

The controversy over the tapes extends into accusations of overclassification and improper assertion of executive privilege. House Oversight Chairman James Comer has argued that Biden cannot claim executive privilege over the tapes since the transcript of his interview was already released publicly.
Further adding to the intrigue, it has been disclosed in federal court by the White House itself that edits were made to the transcript of Biden’s testimony. These modifications were allegedly intended to enhance the portrayal of Biden’s performance during his five-hour session discussing his management of classified documents. During these sessions, Biden reportedly had difficulties answering basic questions about his tenure as Vice President and the year his son Beau died from brain cancer.
