Appeals Court Bombshell: Biden’s Plan Hits a Wall!

In a significant legal development, the 6th U.S. Circuit Court of Appeals has rejected the Biden administration’s efforts to implement policies that would allow transgender students to participate in sports and use facilities corresponding to their gender identity. This decision upholds a prior ruling from a Tennessee federal judge made in 2021.

The ruling came as a setback to the U.S. Department of Education, which had issued guidelines underpinning its directive. These guidelines were initially set forth following the 2020 U.S. Supreme Court decision in Bostock v. Clayton County, which interpreted Title VII of the Civil Rights Act concerning workplace discrimination. The Department extended this interpretation to Title IX, which prohibits sex discrimination in educational settings, arguing a similar basis in text.
