Justice Samuel Alito issued a blistering dissent, condemning the decision as a dangerous overreach by a single district judge.
“Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) 2 billion taxpayer dollars?” Alito wrote. “The answer to that question should be an emphatic ‘No,’ but a majority of this Court apparently thinks otherwise. I am stunned.”
As previously reported, U.S. District Judge Amir Ali—an appointee of President Biden—blocked Trump’s attempt to cancel the foreign aid payments. Ali, a known left-wing activist, has repeatedly attacked Trump, accusing him of anti-Muslim bias while advocating for Black Lives Matter and the defunding of police.
The Trump administration had initially paused the payments for 90 days, citing concerns over how taxpayer dollars were being spent. However, Ali insisted that halting the funds caused “tremendous harm.”
Last week, Ali confronted DOJ lawyers in court, demanding immediate action. “I don’t know why I can’t get a straight answer from you. Are you aware of an unfreezing of the disbursement of funds for those contracts and agreements that were frozen before Feb. 13?” he asked, pressing for compliance.

Ali is now considering whether to impose a longer-term injunction against Trump’s foreign aid freeze, according to ABC News. With the Supreme Court’s ruling, he now has the green light to go further.
If the Court continues to enable activist judges and undermine the constitutional separation of powers, it will only embolden states and individuals to reject its rulings. This decision sets a dangerous precedent where unelected judges dictate executive policy, ignoring the will of the people and their elected leaders.
