The court also emphasized the heightened scrutiny due to the political nature of the case, calling it a “political persecution” of Trump, a leading Republican candidate, by an elected Democratic official.
After the Appeals Court ruling, Willis quickly appealed to the Georgia Supreme Court. However, many legal analysts believe the case is effectively over.
“This case was already in deep trouble because of the conduct of the district attorney, Fani Willis. And now, it’s all but over,” said CNN legal analyst Elie Honig during an appearance on The Jim Acosta Show.
Honig explained that the ruling sends the case into “limbo,” where it may linger indefinitely. “Now as a result of this case, it’s not quite dismissed, but Fani Willis and her office will be disqualified from handling it. And as a practical matter, it now goes into a sort of purgatory for an undefined amount of time. It’s not coming back, it’s over,” he added.
Disqualifying Willis puts the responsibility of appointing a new prosecutor on the Prosecuting Attorneys’ Council of Georgia. According to the council’s Executive Director, Peter Skandalakis, this process is notoriously slow and complicated.
“Once I get it, I start the process of trying to find a conflict lawyer, and I look for somebody who has the resources and would be interested and actually willing to take on the case,” Skandalakis explained in an interview with CNN.
However, the political controversies surrounding the case make it particularly challenging to find a replacement. “It won’t be an easy lift,” Skandalakis admitted.

Willis’ previous disqualification from prosecuting Georgia Lt. Governor Burt Jones in a separate “fake electors” case further complicates matters. That process took 18 months to resolve, and legal experts anticipate a similarly prolonged timeline here.
This latest setback has led many to believe that Willis’ case against Trump is effectively dead. With no prosecutor currently assigned and the taint of controversy surrounding the investigation, the likelihood of the case proceeding appears slim.
For Fani Willis, this ruling is not just a legal blow—it’s a career-defining moment that underscores the consequences of ethical missteps in politically charged cases. As the search for a new prosecutor drags on, this may well mark the end of Willis’ high-profile campaign against Trump.
