After weeks of uncertainty, Senator Bob Casey (D-PA) has conceded the race to Republican challenger Dave McCormick, following a protracted and costly recount process. While McCormick’s victory was first confirmed by the Associated Press just 24 hours after Election Day, Casey held out, insisting on a more thorough count of contested ballots. The delay sparked a costly recount process, which ultimately set Pennsylvania taxpayers back over $1 million.
The race was called for McCormick by multiple outlets, including Decision Desk HQ a few days later, but Casey, who has served as Pennsylvania’s senator for three terms, refused to accept the results. His team pushed for the inclusion of provisional ballots that lacked proper documentation or could not be verified—an action that was met with resistance from state officials. Bucks County, a crucial swing county in the state, played a key role in the dispute. The county’s election commissioners, after receiving the go-ahead from Casey’s team, continued to count ballots with discrepancies despite a ruling from the Pennsylvania Supreme Court which deemed such ballots invalid.

Governor Josh Shapiro and the Pennsylvania Department of State quickly intervened, directing Bucks County officials to comply with the court’s decision. Despite the clear legal directive, some commissioners remained defiant. “People violate laws anytime they want,” said Bucks County Commissioner Diane Ellis-Marseglia, justifying her decision to count ballots that had missing or incorrect signatures. “So, for me, if I violate this law it’s because I want a court to pay attention. There’s nothing more important than counting votes,” she added, reflecting the tension over how to handle the contested ballots.
