According to details shared by FOX News reporter Bill Melugin, the failed immigration deal included several critical provisions aimed at addressing the border crisis. These included mandatory detention of all single adults and a policy that would “shut down” the border once migrant encounters reached 5,000 per day. This figure, Melugin noted, would include 1,400 migrants entering through the CBP One app at designated ports of entry, as well as approximately 3,600 illegal crossings each day.

Under this proposal, once the 5,000 migrant threshold was reached, Border Patrol agents would have the authority to immediately remove illegal immigrants without allowing them to request asylum. This would mark a dramatic departure from current U.S. immigration policies, where asylum seekers are processed under Title 8 once they arrive on U.S. soil. Under the new authority, there would be no processing—only swift deportation back to Mexico or the migrants’ home countries.

Additionally, the proposed “shut down” would come into effect if there were 8,500 migrant encounters in a single day. Once initiated, this policy wouldn’t be lifted until the daily encounters dropped to under 75% of the 5,000 threshold for at least two weeks—meaning an average of less than 3,750 encounters per day over that period. Family units would face different handling, with some being released under Alternatives to Detention (ATD), such as ankle monitors.

Another key component of the bill was a provision to accelerate the removal process for migrants without valid asylum claims. These decisions would be made within six months, far shorter than the years-long process currently in place. Any migrant caught trying to cross the border a second time during a “shut down” phase would face a one-year ban from entering the U.S.

However, a major hurdle to these reforms remains the need for Mexico’s cooperation. The U.S. would require an agreement from Mexico to take back non-Mexican illegal immigrants, a deal that has yet to be finalized.

The Biden administration’s handling of the border crisis has sparked even more outrage following a recent report from ICE’s Deputy Director Patrick Lechleitner. In a letter sent to Congressman Tony Gonzalez, Lechleitner revealed that over 662,000 illegal immigrants with criminal histories are currently on ICE’s national docket.

Even more troubling is that over 425,000 of these individuals have already been convicted of crimes, and another 226,000 are facing pending criminal charges. These individuals, released into U.S. communities under the Biden administration’s lenient enforcement policies, are part of what critics are calling a disastrous “catch and release” strategy.

Among those released are over 13,000 illegal immigrants who have been convicted of homicide, and more than 15,000 convicted of sexual assault. These dangerous criminals are no longer in custody and are instead walking free in towns and cities across America.

The ICE report has fueled widespread concern and anger as the consequences of the administration’s open border policies become more evident. Many are now questioning whether the Biden-Harris regime is serious about securing the border and protecting American communities. Critics argue that until meaningful reforms are enacted, the crisis will only deepen, with law-abiding citizens paying the price for the administration’s failed policies.
