The Biden-Harris administration is reportedly using Schedule A hiring procedures to entrench these bureaucrats. Schedule A is a hiring authority typically reserved for individuals with “intellectual disabilities, severe physical disabilities, or psychiatric disabilities.” However, it also allows for the appointment of specialized professionals such as scientists and attorneys. Unlike other federal appointments, Schedule A hires do not have term limits and are not subject to the same merit-based criteria as other positions.
This tactic, viewed by many as a dirty trick, is being used to ensure that loyalists remain in place, effectively shielding them from being ousted by any incoming administration that might seek to reverse the policies of the current one.
Michael Chamberlain, the director of Protect the Public’s Trust (PPT), a watchdog organization, has raised alarms about this maneuver. “The Biden-Harris administration and its allies have already signaled their intent to hamstring their successor and prevent a future President from reversing their agenda,” Chamberlain stated. “Exploiting non-competitive hiring authorities to fill career civil service positions could be just another component of this scheme. It’s no wonder that the public’s trust in its government has all but disappeared.”
One of the most concerning aspects of this strategy is the hiring of over 100 new immigration judges within the DOJ’s Immigration Review division. These judges, who are responsible for deciding whether illegal immigrants can remain in the United States, are being appointed outside of the traditional merit-based system, according to PPT. This move is particularly significant as Trump has promised to carry out the largest mass deportation in American history should he win the presidency again.
The Biden-Harris administration’s strategic placement of immigration judges who align with their immigration policies could severely hamper Trump’s plans to crack down on illegal immigration. The federal immigration court system is already buckling under a backlog of more than three million cases, a crisis exacerbated by the ongoing border situation.
“The administration is also using Schedule A to install immigration judges—again, outside of the normal merit-based system—who will rule on cases of those in a position to benefit from the administration’s immigration policies,” PPT said in a press release.

In addition to immigration judges, the Biden-Harris administration is also staffing the ENRD division with an army of lawyers. This division is tasked with enforcing environmental laws such as the Endangered Species Act, the Clean Water Act, and the Clean Air Act. These laws are integral to advancing the current administration’s energy and climate agenda.
“The ENRD is a vital office in advancing the Biden-Harris administration’s energy and climate policies, and the placement of Biden-Harris loyalists is a means to defend those policies even if a future Trump (or other) administration seeks to change them,” PPT stated.
By securing these key positions within the DOJ, the Biden-Harris administration appears to be laying down significant roadblocks that any future Trump administration would have to navigate. As Trump continues to signal his intent to reclaim the presidency, the battle lines are being drawn in the fight to control the levers of power in Washington, D.C.
