The Biden-Harris administration is now entangled in a significant legal battle, with the Department of Homeland Security (DHS) being sued over a Freedom of Information Act (FOIA) request related to a controversial election task force in Pennsylvania. The lawsuit, filed by the Center to Advance Security in America (CASA), seeks to force DHS to disclose documents about the creation and operation of this task force, which was designed to combat so-called “election threats” in one of America’s most critical swing states.
The Election Threats Task Force, established by Pennsylvania’s Democratic Governor Josh Shapiro, was announced on February 29th. According to Shapiro, the task force’s mission is to provide “trusted election information” and address potential threats to the election process. However, the specifics of how this task force operates, particularly its collaboration with federal agencies like the Cybersecurity and Infrastructure Security Agency (CISA), have raised serious concerns among transparency advocates and conservative watchdogs.

CASA’s interest in this task force was piqued following a March report by The Federalist, which revealed that Pennsylvania’s Election Threats Task Force was working closely with CISA. This collaboration was not explicitly mentioned in the initial announcement by Governor Shapiro, sparking suspicions about the task force’s true objectives. In response, CASA submitted a FOIA request to DHS-CISA in March, seeking to uncover communications and documents related to the task force. Despite federal law mandating a response to FOIA requests within 20 working days, CASA has not received any documents or further communication from DHS since submitting their request.
