Donald Trump, the former president, is adamant that Special Counsel Jack Smith was improperly appointed when the case involving classified documents was being tried for dismissal.
The federal case claims that Trump improperly retained classified materials after leaving office in January 2021. Trump’s attorneys have filed motions to dismiss the case. Regarding this accusation, the former president entered a not guilty plea to 40 counts.

According to Trump’s legal team, the Presidential Records Act permits him to maintain documents designated as his records during his presidency and to claim absolute immunity.
Furthermore, one of the filings claims that Attorney General Merrick Garland’s appointment of Smith in November 2022 was unlawful since the Senate had not previously approved it. The filing further stated that the “serious problem” had been raised in an earlier argument, which is why the Appropriations and Appointments clauses demand this.
“The Appointments Clause does not permit the Attorney General to appoint, without Senate confirmation, a private citizen and like-minded political ally to wield the prosecutorial power of the United States,” Trump’s lawyers wrote.
“As such, Jack Smith lacks the authority to prosecute this action,” they added.
Donald Trump’s legal team references a previous Supreme Court case in which scholars and Reagan’s former attorney general filed a petition. They contend that Smith, a private individual, wasn’t deserving of the special counsel position.
In December 2023, law professors Steven Calabresi and Gary Lawson, along with former attorney general Edwin Meese, urgently petitioned the Supreme Court to expedite a decision regarding Trump’s immunity from prosecution.
The former president thinks he can use his total immunity to end the federal investigation into what happened prior to the attack on January 6.
