Obama appointee Judge Beryl Howell and Jack Smith are working together to conceal their allegation that Trump was a “flight risk” in order to support a nondisclosure agreement on X/Twitter.
As previously reported, Special Counsel Jack Smith has admitted to giving false information while requesting a secret search order for Trump’s X/Twitter account @RealDonaldTrump.

Company X was fined $350,000 for failing to produce requested records on time.
The fact that Jack Smith had subpoenaed the data in secret escaped Trump’s notice.
A secret order was secured by Biden’s Justice Department, prohibiting X from alerting Trump about Jack Smith’s subpoena.
Throughout the protracted court dispute, X vehemently maintained that the nondisclosure order flagrantly violated both the Stored Communications Act and the First Amendment.
The Justice Department claims that Trump’s actions may endanger the current probe.
CNN reports that the DC Circuit Court of Appeals determined that there were “reasonable grounds to believe” that Trump’s knowledge of the search warrant would “jeopardize the ongoing investigation.”
“The district court, according to the DC Circuit’s opinion, “found that there were ‘reasonable grounds to believe’ that disclosing the warrant to former President Trump ‘would seriously jeopardize the ongoing investigation’ by giving him “an opportunity to destroy evidence, change patterns of behavior, [or] notify confederates.”” CNN reported.

Judge Howell receives Jack Smith’s admission that he lied when he said that Trump would leave if he found out about the secret gag order.

“The district court also found reason to believe that the former President would ‘flee from prosecution,’” read the DC District Court of Appeals’ ruling. “The government later acknowledged, however, that it had ‘errantly included flight from prosecution as a predicate’ in its application for the non-disclosure order.”
“U.S. District Judge Beryl Howell granted the warrant and the nondisclosure order. The appeals court ruling upheld his decision. Howell’s original order is not public, though the appellate court indicated he felt there was reason to believe Trump’s awareness of the warrant could undercut the investigation by allowing him to obstruct it.” Just the News reported.
“Howell evidently agreed with the erroneous elements claiming Trump would be a flight risk, though the appeals court determined that consideration was not the definitive reason for his granting the nondisclosure order.” based on Just the News.

Jack Smith is adamant about getting the word “flight risk” removed from the document.
“The Government now seeks to strike from the NDO language, which can be found at the bottom of page two of the NDO.” they penned in a subsequent document.
