The Subway Incident: Daniel Penny Faces 15 Years

Indictment of former Marine Daniel Penny by a Manhattan grand jury stems from the chokehold death of Jordan Neely in a subway car; the case has generated controversy both locally and nationally owing to the victim’s troublesome background.

Neely, who was notorious for his unpredictable conduct and mental illness, got aboard the train on the day of the incident at roughly 2:30 p.m., generating concern among the passengers with his threats and combative approach. Penny reported that Neely was shouting threats like, ‘I’m going to kill you,’ ‘I’m prepared to go to jail for life,’ and, ‘I’m willing to die.’

The Bowery Residents’ Committee was asked for assistance by Neely, who had 42 prior arrests, three of which were for alleged assault. Sadly, he died with an arrest warrant still out for him for allegedly assaulting a 67-year-old woman in November 2021.

Penny, a college student, described the anxiety and helplessness that permeated the crowded train vehicle in an interview with Fox News Digital. “Between stops, you’re trapped on the train, and there’s nowhere to go. You can try to move away, but you can only do so much on a packed car,” Penny said. “I was scared. I looked around, and I saw older women and children, and they were terrified.”

Penny watched Neely’s actions and stepped in when he thought he could be under the influence of drugs to avert a potentially deadly situation. Neely was effectively taken to the ground by Penny, who approached him from behind and applied a moderate amount of pressure by putting his arm around his neck. They successfully restrained Neely until he lost unconscious with the help of two other people. Unfortunately, Neely’s death was eventually determined by the municipal medical examiner to be a murder from compression of the neck.

The confrontation was only fully documented on cellphone video for the final four minutes, when Neely had already fallen to the ground. You can hear a passenger telling Penny in the video, “You’re going to kill him.”
