“The head honcho of Code Pink here on Capitol Hill decided to try to harass me as I was leaving my hearing with Rubio and smacked my arm,” she said. “I have no issues answering questions, but the moment you touch me, you cross a line.”
The Florida congresswoman further argued that the situation went beyond a simple political disagreement and insisted that physical contact should never be tolerated in public discourse. At the time, she indicated that she intended to pursue legal action over the incident.
Video footage that later surfaced online quickly became the center of discussion. The recording shows Benjamin approaching Luna while attempting to engage her in conversation. Critics of Luna’s account argued that the contact appeared minimal and looked more like an effort to get the congresswoman’s attention rather than a forceful strike.
Even so, Luna’s supporters noted that lawmakers should not be subjected to unwanted physical contact by activists, regardless of political affiliation. The encounter occurred while members of Code Pink were following Luna and questioning her after the hearing.
Before the physical contact occurred, Luna briefly interacted with the activists and appeared willing to respond to questions. The exchange changed tone, however, after the contact was made. The confrontation eventually ended when the activists were warned that Capitol Police could become involved.
Despite differing interpretations of the video, Luna has remained firm in her assessment of what happened.

During a subsequent interview with TMZ, the congresswoman reiterated her belief that Benjamin’s actions crossed a legal line and said authorities have substantial evidence regarding the incident.
“There’s footage of this, they have multiple angles of this, there was multiple witnesses, we have people that filed statements as well, and I think that she’s going to be getting in a lot of trouble. You cannot do that to people,” she said.
Luna went on to frame the situation as part of a broader trend of political hostility that has become increasingly common in recent years.
“We live in a day and age when people feel like they can hurt people because they disagree with them politically. We’ve seen this happen to many conservatives, but I’m sure it also happens on the left as well. That’s unacceptable,” she added.
The congresswoman also expressed confidence that investigators possess enough evidence to move forward if they choose to do so.
“We have more than enough evidence to hold this person accountable and responsible, and let this person be a symbol everyone else that come up here and try to hurt people because they disagree with them.”
When asked directly whether she expects Benjamin to be arrested, Luna did not hesitate.
“Yes, without a doubt,” she responded before reiterating her central argument: “You cannot hit people because they disagree with you.”
