Supreme Court Just Made a Massive Immigration Move!

The Supreme Court on Friday refused to halt a legal challenge to a Trump-era policy that limits immigration judges’ ability to speak publicly, upholding a lower court decision that sent the case back for further review.

The justices rejected the administration’s request to pause a ruling from the 4th U.S. Circuit Court of Appeals, which revived a lawsuit brought by the National Association of Immigration Judges. The order was brief and unsigned, signaling the Court’s unwillingness to intervene at this stage.

However, the Supreme Court made it clear that if the trial court begins discovery before the justices consider whether to take the case, the government retains the option to seek relief again.

At the heart of the dispute is a policy that bars immigration judges “from speaking in their personal capacities about immigration and about the agency that employs them,” according to the judges’ association.
