Murphy Leans on Sotomayor’s Dissent to Justify Defiance

In his ruling, Murphy relied heavily on a dissenting opinion from left-wing Justice Sonia Sotomayor, who, along with Justices Kagan and Jackson, opposed the majority decision.

“Rather than allowing our lower court colleagues to manage this high-stakes litigation with the care and attention it plainly requires, this Court now intervenes to grant the Government emergency relief from an order it has repeatedly defied. I cannot join so gross an abuse of the Court’s equitable discretion,” Sotomayor fumed.

Murphy seized on that statement to assert that his own ruling still stands, arguing the Supreme Court never explicitly overturned his order regarding due process and deportation conditions.

Due to Murphy’s ruling, eight extremely dangerous illegal aliens—some from countries like Laos, Vietnam, and Cuba—are still being detained under extreme conditions in Djibouti, a small African nation with no formal U.S. detention facilities.

President Trump slammed the situation, revealing that the criminal aliens are being held in a makeshift holding area.

According to reports, eleven ICE agents are currently detaining the individuals in a converted Conex shipping container-turned-conference-room at the U.S. Naval base in Camp Lemonnier.

These individuals were en route to South Sudan, a designated third-country for deportation under Trump’s re-implemented immigration policies. However, Judge Murphy claimed that sending them there posed a threat to their safety and denied them “meaningful” due process, citing the need for translators and legal counsel during interviews.
