DCF officials began investigating the family in February after a pediatrician raised concerns of possible neglect regarding the couple’s youngest child, a 9-month-old infant. The situation quickly escalated after the doctor—identified as a mandatory reporter—allegedly threatened to notify child protective services when the parents declined vaccinations for their baby, citing religious reasons.
According to Boston Broadside, the couple, who homeschool their children, expressed a sincere religious opposition to vaccines.
“The parents, who homeschool their children, stated to their pediatrician that they were opposed to their new baby receiving the shots based on their sincerely held religious beliefs.”
Despite claiming protections under Massachusetts’ religious exemption laws, the parents soon found themselves the target of aggressive DCF action.
“This is a blatant violation of fundamental rights on multiple levels,” said Ron Bouchard, a Constitutional Law Strategist. “By what authority has this family been apprehended and for what? Was there a warrant? What is familial kidnapping? A family has the right to travel with their children… What imminent danger exists to justify the drastic action of DCF and the Fitchburg Police Department traumatizing this family by tearing it apart?”
Rivera, who reportedly goes by “Izzy,” told an advocate in Texas that the pediatrician became hostile after the couple refused vaccinations.
“The doctor said if we didn’t vaccinate, he’d have to report us,” Rivera said.
The advocate—who offered shelter to the family during their time in Texas—claimed the parents had proof their children were healthy, well-fed, and in no distress. But that didn’t stop DCF from taking swift action.
“Despite assurances that their baby was well-fed, cared for, and thriving, DCF soon left a notice on their door demanding a home visit. Fearing for their family, the parents refused, citing their rights.”
According to the good Samaritan, police surrounded the couple’s apartment after the family ignored DCF’s demands.
“Ruth Encarnacion hid in the closet with her five children,” the advocate said. “With police and DCF returning in greater numbers the next day, Rivera was also forced to hide, while his wife and children fled from Fitchburg.”

The children—ages 10, 9, 5, 4, and 9 months—were eventually found safe and unharmed in Texas. They are now in the custody of Texas Child Protective Services pending further legal review.
Encarnacion’s attorney, Kevin Carl Larson, insists that his client was acting in her children’s best interest.
“She acted in the best interest of her children,” Larson told the Worcester Telegram & Gazette. “She was protecting her children.”
Larson also argued that Encarnacion was unaware of any official court order and had not been present for any child protection hearing.
“She is not a flight risk,” he added. “She is not going anywhere without her children.”
With parental rights, religious freedom, and state authority colliding in this unfolding drama, this case is now drawing national attention—and it could set a major precedent for families choosing to raise their children outside of mainstream norms.

This is bullshit what has HAPPENED to this couple, u can’t force shots on their kids, especially against their religious beliefs, them shots are dangerous and deadly for infants. They have a right to deny the shots, and take their kids. U can ‘t kidnap your kids, get fkg real. Get off their backs, and leave them alone. U have no business, locking either, one of them up. Turn them loose before u open up a hornets nest, of killer bees, out of control. Seems to b e a very dedicated couple, being harassed, by people without any common sense, back off.
