Without timestamps, defense attorneys could argue that prosecutors cannot definitively place Robinson at the scene when the crime occurred. “If it doesn’t line up in a way that makes sense, it could definitely be bad for them,” Lazaro warned.
Suspicious Return to the Scene
Robinson was arrested 33 hours after the shooting in his hometown in southern Utah. But before his arrest, he allegedly returned to the crime scene — a move that’s left investigators puzzled. According to Fox News Digital, police later found the suspected murder weapon in the same area where Robinson had been seen retrieving an “item” from near a parking garage.
Authorities confirmed that Robinson interacted with a police officer at that time but haven’t clarified the exact sequence of events. Hundreds of terrified attendees had fled the scene, leaving behind personal belongings — making it easier for Robinson to blend in unnoticed.
Crucial Evidence May Rely on Body Cam Footage
If the officer’s body camera wasn’t recording during that encounter, it could become a major issue. “If it doesn’t line up in a way that makes sense, it could definitely be bad for them,” Lazaro reiterated, pointing out that any missing footage could provide the defense an opening to question police conduct.
Digital Trail Could Decide the Case
Prosecutors believe that Robinson’s text messages are a smoking gun. But Lazaro says the digital forensics will be crucial. “A lot of times what you can get when you subpoena cellphone records are where messages were sent from,” she explained. If those records show messages sent from Robinson’s phone in Orem and received in St. George, it could back up the state’s narrative.
However, if that data doesn’t align — or appears incomplete — it could seriously weaken the case.
Defense Gears Up for a Long Fight
The defense has already delayed Robinson’s waiver hearing and is expected to push for even more time to comb through discovery. Lazaro predicts that the defense will likely “spend a lot of time” dissecting timestamps, phone records, and location data to piece together their own version of the timeline.
Twiggs, Robinson’s roommate and romantic partner, is said to be cooperating with investigators — but that may not be enough to secure a conviction.
“It could come out that those aren’t as damaging as they sound,” Lazaro cautioned. “You have to keep in mind, when the government writes a probable cause affidavit, it’s their greatest hits that they have in the moment.”
A Case That Could Define Political Violence in America
The killing of Charlie Kirk sent shockwaves through the conservative movement. A beloved figure and a father, Kirk spent his career fighting for free speech, conservative values, and the next generation of American patriots.
Now, as questions mount and cracks appear in the prosecution’s case, conservatives across the country are bracing for what could become one of the most politically charged trials in recent memory — and one that could determine whether justice is ever truly served for Charlie Kirk.
