A temporary prohibition on “assault weapons” in Illinois has been approved by the US Supreme Court.
“The ruling allows the Illinois law to remain in effect while lower courts deliberate on its constitutional status. Wednesday’s ruling comes after a gun shop owner in Illinois requested an injunction against the ban. The Illinois law bans the sale and new possession of semi-automatic assault weapons. Those who already legally own such weapons would not have to turn them in. The law also bans the sale of large-capacity magazines,” Fox News reported.
“The U.S. Court of Appeals for the 7th Circuit is currently considering the case. The request for an injunction went to Justice Amy Coney Barrett,” the outlet continued.
Late in April, a federal judge imposed a temporary injunction against Governor J.B. Pritzker’s “assault weapons” prohibition, which was bad news for Illinois Democrats. The ban has been temporarily suspended.
According to the Just the News report, legally speaking, “semiautomatic rifles capable of accepting detachable magazines or that can be easily modified to do so” are considered to be prohibited weaponry. Additionally, rifles with exterior features like specific stocks, flash suppressors, or grenade launchers that have nothing to do with their shooting capability also belong into this category.
According to Fox News, previous President Trump’s nominee for the United States District Court, Stephen Patrick McGlynn, underlined the value of maintaining constitutional rights in a recent decision for the Southern District of Illinois.
People who own, produce, sell, deliver, import, or buy assault firearms or.50 caliber rifles are subject to fines under the legislation. Furthermore, people who had a now-banned weapon in their possession at the time the law was passed must register it with the Illinois State Police.
The law forbids the use of accessories or kits that increase the semiautomatic guns’ rate of fire. The law also enforces limitations on the purchase of certain magazines.
The Gun Owners of America, a complainant in the case, insists that Governor Pritzker and the Democratic Party should take note of the new decision.

“Governor Pritzker and his anti-gun cabal in the legislature thought they could steam roll the Second Amendment, and this ruling makes clear that they abused their authority and infringed on their citizens’ rights. We look forward to continuing this fight,” according to Fox News, GOA Senior Vice President Erich Pratt said.
The judge acknowledged the damaging effects of guns in illegal situations in his decision. But he also emphasized that the law restricting Illinois people’ Second Amendment rights was unlawful.
“[Protect Illinois Communities Act] did not just regulate the rights of the people to defend themselves; it restricted that right, and in some cases, completely obliterated that right by criminalizing the purchase and the sale of more than 190 ‘arms,’” McGlynn drafted a decision.
Following a previous decision by Judge Lindsay Jenkins, who was chosen by President Biden to preside over the Northern District of Illinois court, Judge McGlynn recently issued a ruling in the matter. Jenkins refused to stop the law’s execution, but McGlynn’s decision has resulted in further developments in the ongoing legal actions.
“The challenged restrictions on semiautomatic weapons and large-capacity magazines … are consistent with ‘the Nation’s historical tradition of firearm regulation,’ namely the history and tradition of regulating particularly ‘dangerous’ weapons,” Jenkins remarked in her decision.
A federal ban on these kinds of rifles, similar to the one that was put in place during Bill Clinton’s first term as president, has been a consistent pledge made by Biden. Ten years later, during the administration of George W. Bush, that restriction came to an end.
In August, a federal judge in Colorado gave proponents of the Second Amendment a victory.
A recent federal court decision, according to The Reload, a website devoted to discussing firearm-related subjects, prevents the enforcement of a ban on certain kinds of semi-automatic rifles for the second time in as many months.
The fact that President Biden chose the judge in Colorado who overturned the ban adds an intriguing dimension to the case.
