According to a document that was leaked, special counsel Jack Smith intends to prosecute former president Donald Trump with a number of offenses related to the rioting on January 6, 2021. These accusations contain language from the United States Code that dates back to Reconstruction and has been used in the prosecution of J6 defendants and other recent instances involving abuses of voting rights.

The Justice Department is presently reviewing three criminal laws in regard to the former president, according to a letter from Smith that The New York Times has received. As part of the decision-making process about the prosecution of the former president, who is also a major contender for the next elections, these statutes are being taken into account. Although potential charges of conspiring to mislead the government and obstructing an official investigation were always known to be under consideration, this most recent information demonstrates Smith’s intent to prosecute Trump in the same way that those responsible for the J6 incident. Smith contends that when these people illegally entered the Capitol building to support President Joe Biden during the election certification process, they were acting on orders from the president.

It is unlawful under U.S. Code Title 18 Section 241 to: “conspire to injure, oppress, threaten, or intimidate any person” in the “free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States.” Following the Civil War, Congress passed the law in an effort to stop the Ku Klux Klan and other organizations from stopping newly freed slaves from exercising their right to vote.

Smith is anticipated to use successful cases from 1950 and 1974, which featured more extensive tampering, to pursue incidents of tampering with the vote box. The special counsel would need to provide convincing proof that President Trump used similar efforts to annul the 2020 election results in other places, including Georgia, where he is the subject of a separate investigation, in order to hold him accountable. Notably, Rudy Giuliani and John Eastman, two of the previous president Trump’s advisers, have stated that they have not been informed of any prospective legal action.

Defense lawyers for different rioters have questioned the law’s applicability to their clients, claiming that it has been improperly stretched to cover the Capitol riots while its original objective was to address crimes like interfering with witnesses or destroying records.

This accusation is admissible against individuals responsible for the Capitol attack, according to a federal appeals court ruling from April. Although Mr. Trump did urge his followers to travel to Washington on that day and voiced his displeasure with Vice President Mike Pence’s inaction, it is crucial to remember that he did not take part in the storming of the Capitol.

Many J6 inmates now regret their guilty pleas and worry that their convictions may be reversed if President Trump wins re-election. Rep. Marjorie Taylor Greene (R-GA), one of the congressional Republicans, has expressed concern about the appalling circumstances of J6 detainees who are awaiting trial. President Trump would need to travel back to Washington, D.C. for an arraignment if he were to be charged with a crime related to J6, as he expected. Contrary to many J6 inmates, it is doubtful that he would be detained without bail.
