In a bold move just days before the upcoming election, Special Counsel Jack Smith has ramped up his accusations against former President Donald Trump, filing new claims regarding Trump’s alleged role in the January 6, 2021, Capitol riot. According to Smith’s latest filing, Trump “willfully caused his supporters to obstruct and attempt to obstruct” the certification of the 2020 election results.
The allegations come as Smith’s prosecutors continue to pursue charges against Trump, even though the former president had explicitly urged his supporters on that day to “protest peacefully and patriotically.” Despite this, Smith’s team is arguing that Trump bears direct responsibility for the chaotic events that transpired at the Capitol.

The new claims were made in response to a motion by Trump’s legal team, which sought to dismiss the superseding indictment on statutory grounds. This move follows a pattern of legal battles between Trump and the Special Counsel, dating back to earlier this year when Trump faced additional indictments in August. At the time, Smith indicted Trump in Washington, D.C., a move many saw as politically charged, especially in light of a recent Supreme Court ruling on presidential immunity.
