Suffolk County District Attorney Kevin Hayden, also a Democrat, even threatened criminal charges against Sullivan, bizarrely suggesting that ICE was making Boston “more dangerous.”
“I’ve watched ICE actions over the last few months, and I have concerns that those actions are harming our public safety goals,” Hayden complained. “We’re now finding witnesses reluctant to cooperate with investigators due to fear of ICE. This harms public safety.”
What Hayden conveniently left out is that Martell-Lebron isn’t just any illegal alien—he’s a repeat offender with multiple drug trafficking convictions. ICE confirmed this criminal background, yet liberal leaders seem more interested in protecting him than keeping the public safe.
Former federal prosecutor Andy McCarthy tore into the Suffolk County DA’s threats and the judge’s decision during a segment on Fox News, calling it a dangerous misunderstanding of how law and order works.
“I was just gonna say, we have defendants who are in custody on trial all the time. The fact that you’re in custody doesn’t mean your right to present a defense has been in any way compromised. It’s just absurd,” McCarthy said.
He also pointed the finger at sanctuary cities like Boston that are deliberately sabotaging federal immigration enforcement.
“Well I think we tolerated for too long, Dana [Perino], the idea that we can have sanctuaries in the United States,” McCarthy continued. “When they talk about sanctuaries or safe havens, what they mean you’re insulated from is the enforcement of federal law and the courts have been very clear that immigration enforcement is a federal responsibility.”
And he didn’t stop there—McCarthy warned that state officials who obstruct immigration enforcement could face felony charges.
“Whether we like it or not, it is a federal responsibility and if state officials interfere with it, they are holding themselves open, possibly, to even felony charges,” he warned.

Boston has reportedly ignored nearly 200 detainers in 2024—many involving illegal aliens with serious criminal records. Instead of working with federal agents, city officials are more interested in releasing dangerous individuals back into the public.
Former ICE Director Tom Homan has taken this threat seriously. He personally oversaw a major six-day enforcement operation in Boston this year, resulting in 370 arrests. Among those taken off the streets were violent gang members affiliated with MS-13 and Tren de Aragua.
“ICE had to find and arrest these illegal alien rapists because Massachusetts and Boston are sanctuaries that refuse to cooperate with ICE,” Homan said. “They would rather release these animals back into the community rather than honor ICE detainers or notify ICE when they are scheduled to be released.”
Boston officials have chosen to weaponize the justice system against federal law enforcement. By threatening to prosecute an ICE agent for arresting a convicted drug dealer who’s in the country illegally, they’ve shown their true priorities.
Democrats like Judge Summerville and DA Hayden appear more focused on shielding criminal aliens than protecting law-abiding citizens.
As McCarthy, Homan, and countless others have made clear: immigration enforcement isn’t optional, and sanctuary cities are putting lives at risk every day they refuse to comply with federal law.
The American people deserve better.
