The arrest has set off a fierce debate: should Robinson face life behind bars — or should prosecutors pursue the death sentence?
Utah Governor Spencer Cox said Sunday the suspect has refused to cooperate with law enforcement but noted that “all the people around him were cooperating, and I think that’s very important.”
Calls for the death penalty are growing louder, though the process is notoriously slow. In many cases, it can take over a decade before an execution is carried out — if it happens at all. Appeals often overturn death sentences entirely.
Robinson’s attorneys are expected to argue that he acted alone and was not part of any coordinated terrorist network. They may also raise mental health concerns, which could complicate the case for capital punishment.
Utah is one of 27 states that still has the death penalty, but courts often take mental health issues into account before allowing an execution to proceed.
Police confirmed Robinson is under “special watch” while awaiting a full mental health evaluation. He is being housed in the Utah County Sheriff’s Department’s special unit, where deputies can closely monitor his behavior.
The sheriff’s office explained that this status is used for inmates who are accused of violent crimes, show behavioral red flags, or make suicidal statements. However, they noted there is no evidence Robinson has expressed suicidal thoughts so far.
FBI Director Kash Patel revealed Monday that investigators uncovered chilling text messages between Robinson and a close friend.
In those texts, Robinson allegedly wrote he had a chance to “take out Charlie Kirk” and that he was “going to do it.”
Adding to the evidence, Patel confirmed that DNA found on a towel wrapped around the murder weapon — as well as a screwdriver left on the university rooftop — directly links Robinson to the scene.
Governor Cox also told ABC News that while Robinson remains uncooperative, his family — including a romantic partner who is transitioning from male to female — has been assisting authorities. People close to Robinson reportedly told investigators he was “deeply indoctrinated with leftist ideology.”
With the suspect in custody, prosecutors now face mounting pressure to seek the ultimate punishment. Whether Robinson ends up on death row or behind bars for life could become one of the most closely watched legal battles in the country.
