In a move that immediately sparked outrage among gun rights advocates, the nation’s highest court declined to hear a challenge to Maryland’s ban on so-called “assault weapons,” including the widely owned AR-15. The decision leaves the state’s restrictions in place and postpones what many conservatives believe is an inevitable constitutional showdown over the Second Amendment.
As is typical when the Court denies review, the majority offered no explanation. But the silence from the bench was broken by three conservative justices who made it clear they were ready to take the fight head-on.
Justices Samuel Alito and Neil Gorsuch signaled they would have granted review. Justice Clarence Thomas went further, issuing a powerful written dissent that left no doubt where he stands.
“I would not wait to decide whether the government can ban the most popular rifle in America,” Thomas wrote. “That question is of critical importance to tens of millions of law-abiding AR–15 owners throughout the country.”
