The gag order that U.S. District Judge Tanya Chutkan placed on former President Donald Trump in the federal case involving his objections to the 2020 election has been temporarily removed.
In a recent decision, Chutkan prohibited Trump from publicly criticizing the members of the U.S. district court staff, Chutkan’s own staff, and special counsel Jack Smith’s team. Trump is also prohibited from discussing potential witnesses or revealing the specifics of any testimony they could provide. This decision severely limits Trump’s capacity to defend himself during his campaign.
After weeks of arduous advocacy, Special Counsel Jack Smith had argued in favor of the installation of a gag order. His justification was based on his worry that, in the absence of such action, President Trump could be able to “threaten” either the jury or the staff.
Trump’s legal team immediately filed an appeal, claiming that the order was unfair and went against the fundamentals of free and fair elections. In a vehement statement, the campaign described the choice as an abominable act committed by Crooked Joe Biden, who is supposedly trying to quiet his political rival, President Donald J. Trump, who is the front-runner for the 2024 Presidency and a very popular figure in the United States.

Judge Chutkan momentarily delayed her own order following the decision in response to the Trump campaign’s appeal. She asked for briefings on the subject from both the prosecution and Trump’s legal team. Trump has asked for a longer suspension of the gag order, and the Justice Department has until Wednesday to answer. Trump’s legal team must reply by the following Saturday.
