As expected, the usual voices of the establishment were quick to sound the alarm, none more loudly than Andrew Weissmann—the former prosecutor notorious for his role in the Mueller probe. Weissmann erupted in outrage over Trump’s actions, insisting that the president had no authority to remove career FBI employees without cause.
“I’d say the main thing in talking to you as a lawyer and the former FBI general counsel, I dealt with employment issues day in and day out at the FBI. Everything that you are hearing that from Ken, it’s illegal,” Weissmann claimed.
He doubled down, arguing that Trump’s firings violated civil service protections and federal employment laws. “It is against the rules and the law. It’s against civil service rules. You cannot fire career FBI personnel without cause. It is simply not possible. And the idea that you have the acting deputy attorney general of the United States doing something that is against the rules. It’s against the law.”
Weissmann then went a step further, accusing Trump of “weaponizing” the Justice Department by removing government employees who had been involved in January 6-related cases.
“This is the weaponization of the Justice Department that we’re seeing right before our eyes,” he declared.

Ironically, many Americans would argue that the real weaponization of government happened long before Trump took action. For years, the FBI and DOJ have been accused of selectively targeting conservatives, suppressing evidence, and turning a blind eye to Democratic misconduct. YES, federal employees can be fired without cause! The feds like to use the term “Reduction in force” for downsizing due to budgetary constraints, changes in the workload, or just about any other reason. It is NOT illegal to remove someone from their position if their services are no longer needed (or they can no longer be trusted).
