Senator-elect Adam Schiff (D-CA) is under fire after a resurfaced 2018 interview reignited criticism of his past comments condemning then-President Donald Trump’s potential use of the presidential pardon. The controversy has gained traction in the wake of President Joe Biden’s blanket pardon of his son, Hunter Biden, a move that critics argue reeks of political favoritism.

The clip, which has been making waves on social media, features Schiff during an interview with former CNN host Don Lemon. In the video, Schiff criticized Trump’s potential use of pardons for family members under investigation, calling it a potential obstruction of justice. “In the event that the president pardons anyone in an investigation in which the president is a witness, the subject, or the target, those investigative files would all be turned over to the Congress. The Congress ought to know whether the president is using the pardon power to obstruct justice. The American people have a right to know,” Schiff stated. He also defended legislation he introduced to limit such actions, stating, “I think it is clearly constitutional. It doesn’t prevent him from granting a pardon, even a pardon he shouldn’t grant, but it does say that we will be able to at least find out whether the president is using this power to shield himself.”

The timing of Schiff’s past remarks couldn’t be more ironic, as Biden’s recent decision to issue a full and unconditional pardon for his son Hunter Biden has drawn similar accusations of abuse of power. Hunter Biden’s pardon eliminates the possibility of prison time for felony gun charges and tax evasion, both prosecuted by special counsel David Weiss. It also spares the Biden family from a high-profile sentencing hearing that could have been politically damaging.
