According to the memo, immigration officials now have the authority to “review the alien’s parole status to determine, in exercising your enforcement discretion, whether parole remains appropriate in light of any changed legal or factual status.” Huffman emphasized that parole is not an entitlement, stating, “Parole is a positive exercise of enforcement discretion to which no alien is entitled.”
The directive also instructs ICE officials to evaluate whether expedited removal should apply to migrants who were previously omitted. “This may include steps to terminate any ongoing removal proceeding and/or any active parole status,” the memo reads. This expanded discretion is expected to accelerate the deportation process for thousands of migrants.
Migrants Under Biden’s Programs Now at Risk
The Biden-Harris administration’s expanded humanitarian parole programs for migrants from countries such as Haiti, Venezuela, Cuba, Nicaragua, Ukraine, and Afghanistan are now under scrutiny. More than 1.5 million migrants entered the U.S. through these programs or the now-defunct CBP One app, which allowed individuals to schedule appointments at U.S. ports of entry.
Critics, including Republican lawmakers, have accused the Biden administration of abusing these programs to circumvent Congress and allow mass entry of migrants. The Trump administration’s DHS echoed these concerns in the memo, arguing that the asylum process “has been repeatedly abused by the Executive Branch over the past several decades in ways that are blatantly inconsistent with the statute.”
The memo further states, “Most important, the parole statute does not authorize categorical parole programs that make aliens presumptively eligible on the basis of some set of broadly applicable criteria.” This interpretation of the law could result in a reversal of many of Biden’s immigration policies.
Reports of Criminal Activity Fuel Crackdown
The Trump administration’s decision to broaden deportation efforts is also influenced by reports of criminal activity involving some migrants. Communities in Springfield, Ohio; Aurora, Colorado; and Boston, Massachusetts, have reported incidents of gang-related violence linked to Haitian and Venezuelan migrants. White House border czar Tom Homan reiterated that focusing on violent criminals remains a top priority for ICE, stating that this alone will “keep ICE busy for the foreseeable future.”
