The AFL’s investigation covers a wide range of issues, including alleged non-compliance with federal donor privacy laws, failure to enforce federal immigration laws, and inadequate pursuit of equal justice. The organization is also looking into Harris’s handling of potential conflicts of interest and possible cover-ups of misconduct evidence during her time as California’s Attorney General. Public records requests to the California Attorney General’s Office are central to AFL’s strategy in uncovering what they believe to be Harris’s misuse of her authority.
“And so those are really our probes of her not following the rule of law and bending it for a political objective,” Epstein stated. “We also probe numerous kinds of potential ethics issues and failures to disclose conflicts of interest, allowing her own staff as attorney general to engage in fraud and not kind of overseeing that.”
The investigation also revisits Harris’s early career, where her romantic involvement with California Assembly Speaker Willie Brown has raised questions about whether she received undue political favoritism. AFL is now investigating whether Harris properly disclosed any conflicts of interest or recused herself from cases where her impartiality could be questioned.
During her presidential campaign in 2020, Harris faced widespread criticism for her record as a prosecutor, particularly concerning her role in the enforcement of a truancy law in California. Passed in 2011, the law allowed district attorneys to charge parents with a misdemeanor if their children were chronically absent from school without a valid reason. Harris initially supported the law but later distanced herself from its consequences, describing it as having “unintended consequences” during a 2019 podcast interview.
One of the most notable cases tied to this truancy law involved Cheree Peoples, an African American mother who was arrested in 2013 after her child missed 20 days of school. Critics argue that Harris’s enforcement of such laws disproportionately impacted low-income families and minority communities, contributing to the broader issue of mass incarceration.
In addition to her truancy enforcement, Harris’s tenure as San Francisco’s district attorney and later as California’s attorney general has been criticized for being excessively punitive, particularly towards low-level drug offenders. Critics from within the liberal community have accused her policies of exacerbating the mass incarceration problem, especially among black men, rather than focusing on rehabilitation and criminal justice reform.

Another aspect of Harris’s record under investigation is her support for a bail fund that was used to assist Black Lives Matter protesters during the 2020 riots. AFL’s probe is looking into whether Harris’s endorsement of the fund aligns with her proclaimed commitment to justice and law enforcement. According to reports, only a small fraction of the over $41 million raised by the fund was actually used to bail out individuals arrested during the protests.
Epstein further elaborated on the broader implications of the investigation, stating, “It’s fairly clear that nobody disagrees, nobody disagrees that Trump is a felon because of political prosecution. And if the standard for Kamala Harris is that the process that led to Donald Trump being convicted is one of justice and one that she follows, then logically, it means that she is a political prosecutor, not a fair honest broker.”
As AFL continues its investigation into Harris’s legal career, the findings could have significant ramifications for her political future. With her campaign for the presidency in full swing, these renewed allegations and scrutiny of her past actions are likely to play a crucial role in shaping public perception of her candidacy.
