In a bold assertion that ruffled feathers in Washington, U.S. Attorney General Merrick Garland stated on Thursday that the Justice Department is exempt from complying with a congressional subpoena. During a press conference, Garland emphasized, “The DOJ is a fundamental institution of our democracy.” This remark came shortly after President Joe Biden invoked executive privilege to seal the audio from his interview with Special Counsel Robert Hur, stirring controversy among congressional circles.
Garland appeared unsettled as he faced the media, marking a rare moment of public defense. This development followed closely after two Republican-led House Committees—the Judiciary and the Oversight Committees—made moves to hold him in contempt of Congress. The Judiciary Committee has already passed a vote to this effect, and the Oversight Committee scheduled a similar vote for later in the evening.

The tension escalated as Garland described the congressional subpoena as “not legitimate,” arguing that complying would jeopardize the DOJ’s capacity to carry out sensitive investigations. He also expressed frustration over Republican efforts to cut funding for Jack Smith’s investigations into former President Donald Trump, highlighting a politicized battle over justice and oversight.
