In a brief to the U.S. Supreme Court, a former federal prosecutor challenges Special Counsel Jack Smith’s phrasing and begs the justices not to entertain his immunity petition in order to postpone his obstruction trial in Washington, D.C.
Smith may have “shot himself in the foot,” said to Bill Shipley, who is now representing some of the individuals accused in relation to the January 6 disturbance. Smith told the court that there is a “compelling interest” in getting Trump tried as soon as possible.

Trump is that the lawsuit be dismissed, arguing that his acts as president have granted him immunity from four accusations of trying to illegally reverse the outcome of the 2020 election. He is said to have attempted to postpone the federal trial until after the election in an attempt to utilize his lead in the 2024 Republican presidential primary contest to get the lawsuit dismissed, according to Newsweek.
Smith urged the Supreme Court on Wednesday to sustain the ruling of the U.S. Court of Appeals for the D.C. Circuit, which denied Trump’s claims of absolute immunity, and to move on with the trial. No new date has been offered for the March 4th trial, which was originally scheduled.
“Delay in the resolution of these charges threatens to frustrate the public interest in a speedy and fair verdict—a compelling interest in every criminal case and one that has unique national importance here, as it involves federal criminal charges against a former President for alleged criminal efforts to overturn the results of the Presidential election, including through the use of official power,” Smith wrote.
“The public interest in a prompt trial is at its zenith where, as here, a former president is charged with conspiring to subvert the electoral process so that he could remain in office. The nation has a compelling interest in seeing the charges brought to trial,” he added.
Shipley implied on social media that Smith’s assertion that the justices must follow his schedule in order to serve the public interest may have offended some of them.
