The Department of Justice has allowed former IRS contractor Charles Edward Littlejohn to admit guilt to a single felony charge, which could result in a lenient or completely noncustodial sentence during Littlejohn’s upcoming sentencing. Littlejohn illegally accessed and leaked confidential tax records belonging to both Donald Trump and about 7,500 other wealthy individuals.
Prosecutors acknowledge in a recent court document that the plea agreement does not address the crucial problem of the defendant disclosing thousands of tax returns. Even if the defendant had leaked only one return, his possible sentence range would have remained unaltered, which is surprising.
Rather than going to jail for each and every infraction, including the two significant thefts in 2019 and 2020, the Department of Justice (DOJ) is asking for Littlejohn to serve 60 months in prison. This is the most that the statute permits for a single offense. But some political heavyweights are upset about the plea deal, claiming that he should have been sentenced to 60 years instead of just a few months for carrying out the biggest-ever theft of IRS taxpayer data.
Littlejohn, 38, is being defended by attorneys who are pushing for a sentence reduction that is in line with the presentencing report’s suggested range of four to ten months. They stress that, fully aware of their responsible information handling procedures, he shared the pilfered private income-tax data with reliable news outlets, including ProPublica and the New York Times.
