Tensions over US-Mexico border policy escalate as Republican governors band together to back Texas Governor Greg Abbott’s lawsuit against the Biden administration.

Legal objections against the state’s decision led to a convoluted legal struggle. The state suffered defeats in lower courts, but gained a brief reprieve when the 5th Circuit Court of Appeals rendered a favorable ruling. Nevertheless, the Supreme Court ultimately reversed this ruling in a closely divided 5–4 majority.
Amy Coney Barrett and conservative justice Roberts join forces with liberals to grant Biden’s emergency petition. Out of 14 urgent applications, this is the ninth time the Supreme Court has ruled in favor of the Biden administration.
Despite the Supreme Court’s decision, Texas officials—including Governor Abbott and Attorney General Ken Paxton—remain committed to enhancing border security. Members of the Texas National Guard have intervened in Eagle Pass by adding more razor wire.
“The Supreme Court’s temporary order allows Biden to continue his illegal effort to aid the foreign invasion of America,” stated Attorney General Paxton.
“The destruction of Texas’s border barriers will not help enforce the law or keep American citizens safe. This fight is not over, and I look forward to defending our state’s sovereignty,” he added.

Governor Abbott accuses Joe Biden of violating his oath of office and vehemently denounces him for ignoring immigration rules. In addition, he asserts that Texas is under “invasion” and justifies the state’s right to self-defense by citing Article I, § 10, Clause 3.
Examine Abbott’s statement:
Even after receiving many letters, one of which was personally delivered by hand, President Biden has openly disregarded our demand that he carry out his constitutional obligations.
- President Biden has violated his oath to faithfully execute immigration laws enacted by Congress. Instead of prosecuting immigrants for the federal crime of illegal entry, President Biden has sent his lawyers into federal courts to sue Texas for taking action to secure the border.
- President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The effect is to illegally allow their en masse parole into the United States.
- By wasting taxpayer dollars to tear open Texas’s border security infrastructure, President Biden has enticed illegal immigrants away from the 28 legal entry points along this State’s southern border— bridges where nobody drowns—and into the dangerous waters of the Rio Grande.
To safeguard the Texas border, the Texas National Guard, the Texas Department of Public Safety, and other Texas employees are acting. This action is the outcome of the Biden Administration’s noncompliance with Article IV, Section 4 obligations. In retaliation, Texas has cited Article I, Section 10, Clause 3 to establish its right to self-defense and self-protection under the constitution. Any federal legislation that could be in conflict with this power are superseded since it is the ultimate law of the nation. You can be confident that Texas will defend its citizens.
Several other Republican-led states have backed Texas’ action, which has heightened tensions between state and federal officials. Red state governors have openly expressed their support for Texas’s right to self-defense against the illegal Biden administration.
Governor Ron DeSantis of Florida stated his position, stressing the importance of constitutional values and promising to continue supporting Texas.
“If the Constitution really made states powerless to defend themselves against an invasion, it wouldn’t have been ratified in the first place and Texas would have never joined the union when it did. TX is upholding the law while Biden is flouting it. FL will keep assisting Texas with personnel and assets.”
The governor of South Dakota, Kristi Noem, praises the moves taken by Texas and criticizes the Biden administration for creating a national security threat.
“Greg Abbott is exactly right to invoke Texas’ constitutional authority to defend itself. The Biden Administration has created a national security crisis and put Americans in danger. Their failure is an unconstitutional dereliction of duty. South Dakota has been proud to help Gov. Abbott’s efforts to secure our border.”
Governor of Virginia Glenn Youngkin criticizes the Biden administration, claiming that every state is becoming a border state with disastrous consequences for public safety and national security.
“Virginia stands with Texas. Greg Abbott is doing the job Joe Biden and his border czar refuse to do to secure our border. The Biden administration has turned every state into a border state. We must stop the flow of fentanyl, save lives, and secure our southern border.”
Together, Oklahoman Kevin Stitt and Montanan Greg Gianforte criticize the federal government’s inaction. They boldly claim that drug trafficking and related criminal activity have increased as a result of their inactivity.
“Governor Greg Abbott is doing what POTUS won’t. By refusing to act, President Biden is inviting cartels, illegal drugs, and human trafficking into the United States. We must secure the southern border.”
Republican-leaning governor of Georgia Brian Kemp voiced his dissatisfaction with the current state of affairs at the southern border. He underscored the fact that Georgia would always stand with Texas as it takes action to resolve the matter.
“Enough is enough. Our southern border is in crisis thanks to the Biden administration’s refusal to do their job. Greg Abbott and the state of Texas have our full support.”
Sarah Huckabee Sanders, the governor of Arkansas, wrote, “If President Biden won’t defend us, states will have to defend themselves. Arkansas stands with Texas.”
Kim Reynolds from Iowa wrote, “When the federal government fails, states step in. Iowa sent the Iowa National Guard and State Troopers down to the border last year to stop this invasion. Iowa stands with Texas.”
Alabama As Kay Ivey put it, “Texas and the states have stepped up time and time again. The White House? Purposely absent. I have had enough. Texas, you can count on Alabama to have your back.”
Governor Jeff Bezos of Louisiana stated via video, “”Under our Constitution, states are still sovereign. We have the right to protect our citizens.”
A violent struggle over state vs federal jurisdiction in immigration enforcement is ignited as red state governors band together to oppose the Biden administration.
The government of Texas claims that “In August, Governor Abbott held a press conference in Eagle Pass with Iowa Governor Kim Reynolds, Nebraska Governor Jim Pillen, Oklahoma Governor Kevin Stitt, and South Dakota Governor Kristi Noem to provide an update on their joint efforts under Texas’ Operation Lone Star to respond to President Biden’s reckless open border policies. The border visit came after Governor Abbott sent letters to America’s Governors in May requesting support for Texas’ border security mission following President Biden’s decision to end Title 42.
In total, 14 states—Arkansas, Florida, Iowa, Idaho, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Virginia, West Virginia, and Wyoming—have stepped up to support Texas’ efforts and deployed personnel and resources to secure the border in President Biden’s absence.”
