Prior to their client’s indictment, the White House, the Department of Justice, the National Archives and Records Administration, and special counsel Jack Smith’s office exchanged a great deal of information, as disclosed by the former president’s legal team to the federal judge overseeing his case involving classified documents.
Reporter Julie Kelly was present at the U.S. hearing on Wednesday. Miami District Judge Aileen Cannon shared the dramatic events that transpired on social media. One particularly startling revelation she made was the display of “years” worth of security footage from Trump’s Florida resort, Mar-a-Lago.

She also disclosed evidence of substantial and regular communication, previous to the indictment, between the Department of Justice (DOJ)/Jack Smith, intelligence agencies, the White House, and the National Archives and Records Administration (NARA). The purpose of these exchanges was to discuss whether files ought to be included in the indictment.
Kelly restated on Wednesday on X, “To emphasize: Trump’s lawyers told Judge Cannon this afternoon they have evidence that the Biden White House collaborated with NARA, DOJ, and intel agencies to determine which documents to include in Jack Smith’s indictment.”
An exclusive story published by Just the News in August 2022, during the high-profile FBI raid at Mar-a-Lago, disclosed that the Biden administration actively worked with the Justice Department and the National Archives to begin a criminal investigation into the former president Trump.
White House Deputy Counsel Jonathan Su has been in regular contact with the FBI, DOJ, and National Archives as early as April, according to recently obtained government records.
“By May, Su conveyed to the Archives that President Joe Biden would not object to waiving his predecessor’s claims to executive privilege, a decision that opened the door for DOJ to get a grand jury to issue a subpoena compelling Trump to turn over any remaining materials he possessed from his presidency,” Just the News said.
Acting National Archivist Debra Steidel Wall wrote to Trump’s attorneys on May 10, 2022, emphasizing the White House’s involvement.
“On April 11, 2022, the White House Counsel’s Office — affirming a request from the Department of Justice supported by an FBI letterhead memorandum — formally transmitted a request that NARA provide the FBI access to the 15 boxes for its review within seven days, with the possibility that the FBI might request copies of specific documents following its review of the boxes,” Wall wrote Trump attorney Evan Corcoran.

She was told by the White House counsel that Biden granted her the power to determine whether to back Trump’s assertion of executive privilege.
“I have therefore decided not to honor the former President’s ‘protective’ claim of privilege,” Wall wrote.
Emeritus professor of law at Harvard University Alan Dershowitz questions the Biden White House’s claim that it can override Trump’s executive privilege.
“I was very surprised,” Dershowitz told Just the News after reading Wall’s letter. “The current president should not be able to waive the executive privilege of a predecessor, without the consent of the former president. Otherwise, [privilege] means nothing. What president will ever discuss anything in private if he knows the man who beat him can and will disclose it?”
Kelly proposed that the May 20, 2024, start date of Trump’s trial regarding secret documents be postponed.
“Just left classified docs case hearing in Judge Cannon courtroom,” she wrote. “She will consider a modified trial schedule given numerous issues including voluminous discovery, discovery delays, late delivery of secure location to review evidence and Trump’s conflicting trial schedules.”
Politico reports that Cannon told the lawyers, “I’m just having a hard time seeing how realistically this work can be accomplished in this compressed period of time,” in reference to the current circumstances.
The goal of Trump’s legal team is to push back the trial until after the election in November 2022.
“Proceeding to trial during the pendency of a Presidential election cycle wherein opposing candidates are effectively (if not literally) directly adverse to one another in this action will create extraordinary challenges in the jury selection process and limit the Defendants’ ability to secure a fair and impartial adjudication,” the attorneys wrote in a court document dated July.
On Wednesday, Cannon was notified by Trump’s legal team that their May concentration on the papers issue would make it difficult for them to get ready for the special counsel’s investigation into election meddling in March.
The lawyers’ arguments suggest that the trial concerning electoral interference could continue on for several months. If the current start date stays the same, this timeframe might coincide with the papers case in May.
Trump is now facing 91 major criminal accusations in all, brought by Democratic and Smith prosecutors from New York City and Fulton County, Georgia.
