Today, Sidney Powell and the Fulton County District Attorney reached a plea agreement. She entered a plea of guilty to six counts of “conspiracy to commit intentional interference with the performance of election duties.”

All of these accusations fall under the misdemeanor category. Six years of probation, a $6,000 fine, and $2,700 in restitution payments are among the possible penalties.

Consider the defense to have won there. This is why.

Powell is accused of major offenses such computer theft and conspiracy to commit electoral fraud. He is also charged with cheating the state and breaking Georgia’s RICO law.

These accusations are regarded as major crimes with grave repercussions. For instance, those found guilty under Georgia’s RICO conspiracy law risk a sentence of five to twenty years in jail. Refer to Georgia Code Ann. 16-14-5.

Let’s talk about our second argument, the possibility of conviction.

I have no doubt that Powell is innocent and that neither she nor anyone else is a part of a RICO conspiracy. The accusations and every deed connected to the alleged conspiracy are absurd. It is my firm conviction that this case should never have been prosecuted and that it unjustly criminalizes political behavior (I will go into details regarding the charged conduct and RICO below). It’s crucial to remember that neither I nor you are Fulton County jurors.

It is unknown at this time whether Kenneth Chesebro will choose a plea bargain, proceed to trial on October 23, or even receive a deal at all. But it’s crucial to remember that the majority of the jury pool—roughly 75% of it—consists of Democrats, with only 25% of it being made up of Republicans. It is clear that these jurors might be biased against anyone associated with Donald Trump and have a strong desire to convict them. Previous cases in Washington, DC, involving January 6 defendants and an anti-Trump activist who dishonestly sat on the Roger Stone jury revealed this bias. In these situations, it appears that political objectives come before the pursuit of justice.

The trial’s cost and length are increasing the already high pressure. The Fulton County District Attorneys estimated that this case would go on for four months in September. This trial could leave the defendant bankrupt due to the large number of witnesses and the defense’s ongoing case presentation.

The Fulton County District Attorney tried to drive Powell and Chesebro, the only defendants who requested a fast trial, into accepting a plea deal by using protracted trial tactics. This is simply another illustration of the shady conduct practiced by the aggressive Fulton County prosecutors. These prosecutors have engaged in a number of public wrongdoings, including misrepresenting Georgia law to the trial judge and hiding important evidence from the grand jury, both of which violate the prosecutor’s duty to uphold justice. The plea agreement further shows that the prosecutors overcharged Powell and further demonstrates their unethical behavior.

The agreement shows how reluctant Fulton County prosecutors are to hold a trial right now. A lengthy trial lasting four months with multiple witnesses would unintentionally bolster Donald Trump’s defense. There would be no space for surprises because all the witnesses would be present and accounted for, and any holes in the prosecution’s case would be exposed.
