An attorney claims that there is one strong defense that might successfully dismiss the federal charges brought against the former president Donald Trump.
Leo Terrell, a human rights lawyer, believes that Trump’s defense against the allegations brought by special prosecutor Jack Smith about the improper handling of secret materials might greatly benefit from the Presidential Records Act. According to Terrell, this action will have a big impact on how well Trump defends himself against these accusations, according to Fox News.

Terrell made his comments on a forthcoming edition of the well-liked Fox News program “Life, Liberty & Levin.” For the enlightening debate, be sure to check in this Sunday at 8 p.m. Eastern Time.
According to Terrell, using the 1978-created and 1990-amended statute should result in an “outright dismissal of these frivolous charges against Donald J. Trump.”
According to the Presidential Records Act, the President is in charge of their records while in office. The documents are turned over to the United States Archivist when a president completes their term in office.
According to Terrell, the action clears Trump.
“President Trump had the absolute right to declassify any and all documents in his custody, control and possession. There has been no response to that by the prosecution, Terrell said, according to Fox. “I’ll tell you why: Because they don’t have one.”
He claims that mentioning the conduct is equivalent to declaring “game over.”
“That is, to me, the most important first motion President Trump’s legal team could file,” he said.
Terrell claimed that the prosecution’s goal was to prevent Trump from assuming the presidency.

“The leading Republican candidate, in my opinion, the next president of this country, is trying to be derailed by the prosecution, by Joe Biden, by Merrick Garland, by Christopher Wray and the Democratic machine… and the left-wing media,” he said.
Politico reported that Trump’s attorneys are asking to delay the trial until after the 2024 presidential election.
“Proceeding to trial during the pendency of a Presidential election cycle wherein opposing candidates are effectively (if not literally) directly adverse to one another in this action will create extraordinary challenges in the jury selection process and limit the Defendants’ ability to secure a fair and impartial adjudication,” Trump and co-defendant Walt Nauta’s lawyers wrote in a document.
Prosecutors reportedly refuted such claim, according to the Associated Press.
“Our jury system relies on the Court’s authority to craft a thorough and effective jury selection process, and on prospective jurors’ ability and willingness to decide cases based on the evidence presented to them, guided by legal instructions from the Court,” According to the AP, the Justice Department stated in its legal response.
“To be sure, the Government readily acknowledges that jury selection here may merit additional protocols (such as a questionnaire) and may be more time-consuming than in other cases, but those are reasons to start the process sooner rather than later.”
