On May 1, Penny was one of several commuters who intervened to defuse a situation with Neely, a homeless guy who was posing a threat to other train passengers. They managed to restrain him, protecting both themselves and other people.

Neely allegedly demonstrated a troubling willingness to hurt people on the train, even saying he was willing to “take a bullet” or go to jail for his crimes.

The incident’s video clearly shows a group of individuals trying to hold Neely down, including Penny, who placed him in a headlock. Sadly, Neely was already dead when the emergency personnel arrived and couldn’t be revived.

Penny’s legal team, according to News 12, asserts that their client is innocent and only acted to defend himself and other passengers.

Neely, a violent offender with a long history of arrests, is currently wanted by the police for his part in a 2021 brutal assault on a 67-year-old woman.

Following the decision by Manhattan District Attorney Alvin Bragg to prosecute Penny with second-degree manslaughter, Penny turned himself in to the police on Friday. Penny could spend as much as 15 years in jail if proven guilty.
