Congressman Byron Donalds challenged CNN host Jake Tapper, who was anti-gun.

Tapper has experience working on the campaigns of Democratic candidates and for a group that backs gun control laws that some claim could result in the outlawing and seizure of all firearms in the United States.

Red flag regulations, according to Donalds, are flagrantly unconstitutional and infringe both the Second and Fifth Amendments.

Donalds said something important concerning red flag gun confiscation laws during the interview. He thinks that these laws violate the Constitution’s takings provision because they rob Americans of their legal property without providing any sort of due process. He further emphasized how these laws violate peoples’ rights by requiring them to prove their innocence in court. In addition to being thought-provoking, Donalds’ opinion raises important issues on how to strike a balance between gun control and the liberties granted by the Constitution.

“The issue with red flag laws is that the U.S. citizen who somebody thinks might have mental health issues, their property is taken from them and then they have to go to court to get their property back if its found out the mental health claims are actually invalid,” Donalds stated.

In a recent discussion, Tapper stated his belief that having a gun endangers one’s right to life. This statement, however, caused people to scratch their heads because Tapper and other liberals do not extend the same right to unborn children in the womb. This idea has created a discussion over what constitutes a person’s right to life and to whom it should apply.

“Risk protection orders take away your property, and then you have to go to court to get your property back. That is a fundamental taking under the United States Constitution,” Tapper asserted.

“I understand your point but what about the Constitutional rights of those three nine-year-olds at Covenant School in Nashville, or the three faculty and staff members or the five individuals killed at the Louisville bank, they have the Constitutional right to life and I understand your concerns about the Second Amendment rights of an individual, but don’t those rights matter less than the individual right to live?” Tapper asked.

Donalds skillfully refuted Tapper’s claim by pointing out that the treasured Declaration of Independence wonderfully enumerates the core American rights of life, liberty, and the pursuit of happiness. He wisely emphasized that an elected official’s responsibility should be to uphold all of the rights that the American people cherish, without exception or consideration for any particular political goal.

“Well actually, Jake, I think you’re conflating ‘life, liberty and the pursuit of happiness’ in the Declaration of Independence, not the United States Constitution,” Donalds responded. “We all want to protect life at all times but that doesn’t mean you get to abridge rights of American citizens . . . If you want to go through the legal process and adjudicate mental health, I’m all for that. But you can’t take somebody’s property from them and then they have to petition the court to get their stuff back. That’s the wrong way to go.”
