A Biden-appointed federal judge has thrown out a criminal charge against a Jamaican national accused of illegally casting a ballot in the 2020 presidential election, concluding that Congress exceeded its constitutional authority when it made noncitizen voting in federal elections a crime.
The extraordinary decision came from U.S. District Judge David S. Leibowitz of the Southern District of Florida, who was nominated to the federal bench by former President Joe Biden in 2024.
Leibowitz dismissed the charge against Chelsea Michelle Ann Cox, a Jamaican national whom federal prosecutors accused of knowingly voting in Broward County despite not being an American citizen.
