“This Court’s eagerness to playact a district court here has serious consequence,” Kagan wrote. “The majority calls its ‘evaluation’ of this case ‘preliminary.’.. The results, though, will be anything but.”

Kagan further warned that the decision favors partisan advantage at the expense of voters. “This Court’s stay guarantees that Texas’s new map, with all its enhanced partisan advantage, will govern next year’s elections for the House of Representatives. And this Court’s stay ensures that many Texas citizens, for no good reason, will be placed in electoral districts because of their race,” she continued. “And that result, as this Court has pronounced year in and year out, is a violation of the Constitution.”

Under the new plan, five Democratic-held districts in Texas are reshaped to lean more Republican, potentially flipping them in favor of the GOP. Meanwhile, California voters approved Proposition 50, which adds five Democrat-leaning districts, making the Golden State the most heavily gerrymandered in the nation.

Texas’ effort to redraw its map began this past summer after the Trump Administration raised concerns about race-based districting and census “errors” that allegedly overcounted Democrat states while undercounting Republican-leaning areas, including Texas.

The Lone Star State’s move ignited a nationwide redistricting battle. Democrats countered with California’s Proposition 50, while GOP-controlled Missouri and North Carolina redrew maps to gain one additional Republican seat each.

Looking ahead, Democrats have promised further action, targeting Republican districts in Virginia and Illinois—though the latter poses a challenge due to existing district lines and a significant GOP voter base. Meanwhile, former President Trump is actively lobbying Indiana state senators to approve maps that could add two more Republican-controlled districts.
