The War Department also said the process will be handled carefully and in accordance with the law. “This matter will be handled in compliance with military law, ensuring due process and impartiality,” officials stated. They added that the Pentagon will not provide additional details during the review to avoid interfering with the investigation.

That restraint has not prevented speculation. Kelly’s critics argue that he crossed a red line by appearing to encourage troops to defy the commander in chief if they disagree with Trump’s decisions. His supporters claim he was warning about hypothetical unlawful actions, not pushing for rebellion. But the Pentagon’s swift response suggests the video was interpreted very differently inside military channels.

Kelly is not an obscure figure in the Senate. As a former Navy combat pilot and astronaut, he has long used his military credentials to bolster his political influence. That background is also exactly what makes this situation so explosive. A civilian politician might receive a public rebuke for similar comments. A military retiree, however, remains attached to the code that governed him in uniform.
