Former FBI Director James Comey’s criminal case just took a dramatic turn — and not in the way Biden’s Justice Department hoped. A federal magistrate judge has issued a bombshell warning that the government’s handling of the prosecution may have crossed serious legal lines.
Magistrate Judge William Fitzpatrick delivered a stunning rebuke this week, openly suggesting that misconduct inside the DOJ could have tainted the grand jury proceedings that produced the indictment against Comey. And he didn’t stop there.
The judge took an “extraordinary” and almost unheard-of step, ordering prosecutors to hand over secret grand jury materials directly to Comey’s defense team. That type of transparency is something federal courts almost never approve — unless there is strong suspicion something went very wrong.
Fitzpatrick spelled out his concerns bluntly. “The Court recognizes this is an extraordinary remedy,” he wrote, “but given the factually based challenges the defense has raised to the government’s conduct and the prospect that government misconduct may have tainted the grand jury proceedings, disclosure of grand jury materials under these unique circumstances is necessary.”
Translation: the judge believes something doesn’t smell right at the DOJ.
